Probate is the legal process that gives someone authority to deal with the property, money, and possessions (the estate) of someone who has died. It requires a Grant of Probate from the Probate Registry. Most commonly a Grant of Probate will be required if the deceased owned assets in their sole name.
Not always. If the estate is small (typically under £5,000) or assets are held jointly with a spouse or civil partner, you may not need Probate. However, if the estate includes property, shares, or certain investments, you will need a Grant of Probate.
Usually, the executor named in the Will obtains probate. Where there is no Will, an administrator is appointed to manage the estate. This is often a close relative who is entitled to be appointed under the intestacy rules.
