The Court of Protection handles decisions for individuals who are unable to make choices themselves due to loss of mental capacity. Our experienced team, led by Matthew Edwards, support clients through every step of this complex and sensitive legal process.

When a loved one cannot make important decisions due to conditions like dementia or a brain injury, the Court of Protection steps in to protect their interests. The Court’s role is to act in the person’s best interests, following the principles of the Mental Capacity Act 2005. Our specialist solicitors can help with Court of Protection applications. These include applications for Deputy appointments to manage finances and property, the appointment of trustees to sell property, approval of Statutory Wills and Estate Planning. We also assist when there are concerns about mismanagement or financial abuse by previous deputies or attorneys, helping recover lost assets and seeking the removal of unsuitable representatives.

What is the Court of Protection?

It’s a specialist Court that makes decisions for individuals who lack the mental capacity to make decisions themselves, ensuring their welfare and finances are protected.

When is a Deputy appointed?

When someone cannot manage their property or financial affairs, the Court may appoint a Deputy – often a trusted family member or friend – to act on their behalf.

What is a Statutory Will?

This is a Will approved by the Court of Protection on behalf of someone who lacks capacity, ensuring their wishes are respected as far as possible.

Can the Court remove a Deputy or Attorney?

Yes, if they are not acting in the person’s best interests, especially in cases of financial abuse.

How do you support families during Court of Protection cases?
