Victimisation is unlawful under the Equality Act 2010.
Victimisation is being treated less favourably because you made or supported a complaint to do with a ‘protected characteristic’, or someone thinks you did.
Protected characteristics under the law are:
- Age
- Disability
- Gender reassignment
- Marriage and Civil Partnership
- Pregnancy and maternity
- Race
- Religion or belief
- Sex
- Sexual orientation
You do not have to complain about your own discrimination, and you do not have to have a protected characteristic yourself.
An individual should not be subjected to a detriment, discipline or dismissal for complaining about discrimination or harassment in the workplace.
