Understanding Settlement Agreements – what you need to know

A settlement agreement is a legally binding written contract that finalises the terms upon which your employment ends, preventing you from making future claims against your employer in exchange for compensation.

Settlement agreements provide certainty and closure, helping both employers and employees move forward with confidence. Legally, these agreements must be in writing, relate specifically to the dispute, and that you have received independent legal advice on the terms and effect of the agreement. Your solicitor’s details and professional indemnity cover must also be specified.

Typical terms in a settlement agreement include the amount and timing of your compensation payment, any restrictions after your employment ends (like confidentiality or non-compete clauses), where relevant, share or option treatment and the nature and wording of your reference and any agreed departure announcement. Some claims, such as personal injury or future pension rights, may be excluded.

The first £30,000 of qualifying termination payments can usually be paid free of income tax. Our solicitors will advise you on the tax treatment and help structure your settlement as efficiently as possible. Using our online settlement agreement service lets you submit your details securely in minutes. We’ll contact you promptly to discuss your options and begin providing the advice you need without delay.

At Pinney Talfourd, we are here to help you navigate this sensitive process with professionalism, empathy, and expertise, protecting both your immediate and long-term interests.

Settlement Agreements FAQs

We understand you might be looking for answers, so we’ve compiled a list of frequently asked questions to help get you started.

What is a settlement agreement?

A settlement agreement is a formal, legally binding written contract that sets out the terms on which an employment relationship ends. It prevents you from making future claims against your employer in return for agreed compensation.

Why do I need independent legal advice?

Independent legal advice ensures you fully understand the agreement’s terms and consequences. It protects your rights and confirms that the settlement is fair and lawful.

What can a settlement agreement include?

Common elements include financial compensation, references, confidentiality and non-disparagement clauses, waiver of claims, warranties and indemnities, post-employment restrictions, and agreement on legal fees. Each agreement is customised to your situation.

How long does it take to review a settlement agreement?

While timelines vary, we aim to provide timely advice, often within one working day after receiving full details, to help you respond speedily and confidently.

What if I disagree with the settlement offer?

Our solicitors will negotiate on your behalf to improve terms or explore alternatives, ensuring you receive the best possible outcome for your circumstances.
