Ophthalmic Claims

Personal Clinical Negligence Ophthalmic Claims

Ophthalmic claims relate to eye conditions, diseases and injuries. Some eye ailments can be difficult to identify and treat without expert assistance from specialist doctors and other medical professionals. Some conditions come on quickly and require urgent treatment, whereas others are a slower process, providing more time and opportunity to treat them before further deterioration takes place.

On occasion some conditions are overlooked or not monitored or treated properly, resulting in significant deterioration which may not be restorative. Issues tend to arise when there is a failure or delay in recognising and diagnosing a condition or where inappropriate treatment/surgical intervention is provided. Our clinical negligence solicitors have been instrumental in bringing many ophthalmic claims to a successful resolution for clients across the UK.

Conditions which may give rise to a claim include:

  • Undergone laser eye surgery and have been left with an unwanted side effect or deterioration
  • Suffered symptoms that you were not advised about
  • There has been a failure to refer you to an appropriate specialist
  • Surgery was undertaken in inappropriate circumstances
  • Surgical intervention was substandard

You may be eligible for a claim for compensation.

[tela_accordion title=”Cataracts Claims”]
Cataracts are clouding of the eye which prevents light getting through and can cause partial or complete loss of vision. Symptoms include blurred and cloudy vision and difficulty in identifying differences in shadows, colours and contours.

Cataracts are usually age-related, but lifestyle factors can play a part. Smoking and excessive exposure to the sun can result in cataract development. Diabetics or those with hypertension are also more likely to develop cataracts. Such groups of people must, therefore, be monitored and treated promptly upon the first signs of cataracts.

Genetics or infection can result in people being born with glaucoma and if this is not treated swiftly it can lead to permanent loss of vision.

Whether or not you are predisposed to such a condition, it is important to look after your eyes and attend regular eye tests to help detect any early changes in the eyes.

Early cataracts which do not affect sight will be left until they become intrusive. If surgical treatment does become necessary then the lens will be removed and replaced with an artificial one. The procedures are quite quick and can be done under local anaesthetic. It is important that you are properly monitored and action is taken when the symptoms become intrusive.

If you believe that you have a negligence claim for cataracts, please contact our team of expert solicitors who can advise you further.

[tela_accordion title=”Glaucoma Claims”]
Glaucoma relates to damage to the optic nerve and can permanently affect vision and result in blindness if left untreated. It can, but not always, result from a build-up of fluid and increased pressure in the eye. On most occasions, the condition is identified and treated swiftly. Eye drops and tablets can assist in preventing fluid production so as to keep the raised intraocular pressure (IOP) low. Surgery may also be required.

IOP is an easy identifier of potential glaucoma and when presented with a raised IOP, the patient should be referred for further investigation. Where identified, glaucoma can be maintained and deterioration prevented. If such referral and swift action is not undertaken, then the patient is at real and significant risk of deterioration and irreversible visual loss.

If the optic nerve has been damaged, it cannot be reversed. The focus, therefore, turns to ensuring no further damage is done. If the condition is detected early enough, progression of the disease can be halted or slowed.

If left untreated, glaucoma can lead to blindness. Our medical negligence solicitors in Essex and London are well-versed in dealing with cases relating to glaucoma claims and are here to assist you further.

[tela_accordion title=”Detached Retinas Claims”]
Nothing can replace sight, but obtaining compensation where there has been negligence can assist in ensuring you have sufficient funds to cover future treatments, needs, aids and adaptations required as a result of the injury, illness or condition. Our team medical negligence solicitors in offices across Essex and London have many years of experience in dealing with claims relating to detached retinas.

This condition can affect the elderly and anyone who has suffered a trauma to the eye. The retina needs a constant supply of blood and without this, the nerve signals begin to die, resulting in a loss of vision if left untreated.

Early warning signs include flashes of light in the outer vision, increased floaters in the eye and so on. An ophthalmic surgeon can advise on the most suitable treatment, which usually consists of surgery to reattach the retina. If the condition is not caught early and acted upon urgently, the symptoms are likely to progress until there is full visual loss.
