Many areas of life are dictated by the “Post Code Lottery” but few would expect this to apply to the family judicial system…. However, having read the accounts of those attending the Law Society Gazette’s Roundtable discussion on family law it would appear the justice system has an approach to divorce, children and relocation that is horizontally and vertically inconsistent.
It is thought that District Judges separated by a county line give different treatment of cases with near identical facts. The High Court is also known to take a different approach in relation to questions of relocation to some county courts.
It DOES therefore matter which Judge you appear before and in which court your case is heard.
