There are two different legal elements to a fatal accident claim, although these can overlap:
- The Law Reform (Miscellaneous Provisions) Act 1934 – This allows a claim to be brought on behalf of the estate.
- The Fatal Accidents Act 1976 (as amended) – This allows a claim to be brought on behalf of the dependants of the deceased.
