Auction Property

Buying or selling a property at auction requires expert legal advice to ensure a smooth, confident process. We’re here to support you every step of the way, providing clear, practical advice tailored to auction property transactions.

Personal Residential Property Auction Property

Navigating Auction Property sales and purchases with confidence

Expert legal support navigating the unique challenges of buying or selling property at auction.

Auction property transactions can be fast-paced and demand precision to avoid pitfalls. Whether you’re a buyer or seller, understanding the legal requirements before auction day is essential. At Pinney Talfourd, we combine significant property law expertise with a personal, proactive approach.

For Buyers we would always advise a thorough investigation of title prior to committing to a purchase.

Most Auction Lots come with an Auction Pack, that includes many of the documents to be found within the draft Contract Pack supplied by a Selling Lawyer in a traditional sale. The difference here is that whilst the traditional route then has several weeks, if not months to peruse and raise enquiries/investigate, once the hammer falls and you are the successful bidder, you are buying that Property outside of very specific and unusual scenarios.
We will review the Pack prior to Auction and give you the best information possible at that point for you to make an informed decision. We will assist with raising any enquiries through the Auction House, but often this proves difficult and you’re obliged to proceed with the information available.

For Sellers we can prepare the Auction Pack and include the correct information to ensure the Lot has the most interest possible on the day of Auction.

For Sellers and Buyers, we can assist once the Auction is over, with the legal procedures for Completion, usually 20 working days after Auction itself.

Our property team is dedicated to outstanding client care and effective results in residential property work. We understand that auction purchases often involve tight deadlines and complex terms. We work closely with you to clarify uncertainties early on and manage deadlines efficiently. Our team prioritises clear communication, so you always know where you stand and what you need to do.

We see ourselves not just as your lawyers but as your trusted partners – delivering peace of mind through expert guidance tailored to your unique auction journey.

Auction Property FAQs

We understand you might be looking for answers, so we’ve compiled a list of frequently asked questions to help get you started.

What is included in the legal pack for auction properties?

The legal pack typically contains the contract for sale, title documents, searches, and any special conditions. We can draft or review these carefully to advise you on any issues before auction day.

Can I withdraw my bid after winning an auction?

No, bidding at auction creates a binding contract once the hammer falls. It’s vital to understand your commitments beforehand, and we’re here to make sure you do.

How much deposit do I need when buying at auction?

Usually, a 10% deposit is required immediately after winning the auction. We advise on this and help arrange for secure transfer.

What happens if I’m selling a property at auction?

We prepare the legal pack, advise on contract terms, and ensure any title or boundary issues are addressed in good time to support a successful sale.

How quickly must completion happen after the auction?

Completion typically occurs within 20 working days of the auction. We manage timelines closely to keep the process on track and stress-free.
